Allahabad High Court Rules on Caste Certificate Jurisdiction in Election Petitions
Allahabad High Court clarified that an Election Tribunal can't check or cancel a caste certificate during an election petition. Justice Neeraj Tiwari ruled that only state-appointed Scrutiny Committees have this power.
This happened after a challenge to the 2022 Uttar Pradesh Legislative Assembly elections for Ram Kola constituency. The petitioner questioned if the winning candidate's Scheduled Caste certificate was valid. The court said that once a competent authority issues a certificate, you must challenge it through District, Divisional, and State Level Committees. You can't do it through an election petition.
Caste Certificate Verification Rules
The court used Supreme Court examples. It noted that courts should avoid doing wide searches into things that these specialized committees already handle. So, the election petition was dismissed.
